Terms of Service
The agreement that governs your use of FlyData Systems.
Agreement
These Terms of Service (“Terms”) constitute a legally binding agreement between you and FlyData Systems (“FlyData Systems,” “we,” “our,” or “us”) governing your access to and use of the FlyData Systems website, mobile application, and all related products and services (collectively, the Services).
The FlyData Systems application enables users to purchase, activate, and manage eSIMs and mobile data plans for use across local, regional, and international mobile networks.
By creating an account, accessing, or using any part of our Services, you acknowledge that you have read, understood, and agree to be bound by these Terms. If you do not agree with these Terms, you must not access or use our Services.
If you are using the Services on behalf of a company or other legal entity, you confirm that you have the authority to bind that organization to these Terms.
FlyData Systems reserves the right to suspend, restrict, or terminate access to the Services if these Terms are violated.
1. Services
FlyData Systems provides a digital platform that allows users to purchase and manage eSIM-based mobile connectivity services.
Depending on availability, our Services may include the ability to:
- Browse and purchase local, regional, or global eSIM data plans.
- Activate eSIMs using QR codes or activation details.
- View available balances, data usage, and transaction history.
- Share purchased eSIMs through supported communication channels.
- Manage account information, payment methods, and service preferences.
We may introduce, modify, or discontinue features at any time without affecting your statutory rights.
2. Eligibility and Account Registration
To use our Services, you must meet the following requirements:
- You must be at least 18 years of age or have the consent of a parent or legal guardian where permitted by applicable law.
- You must use a device that supports eSIM technology. FlyData Systems is not responsible if your device is incompatible.
- You must provide accurate and complete registration information.
You may create an account using an email address or any supported third-party authentication service, such as Google or Apple.
You agree to keep your account information accurate and up to date at all times.
3. Account Security
You are solely responsible for protecting the confidentiality of your account credentials, including your password and any authentication methods associated with your account.
Any activity carried out using your account will be considered your responsibility unless you notify us that your account has been compromised.
If you believe your account has been accessed without authorization, you should contact FlyData Systems immediately using the contact details provided at the end of these Terms.
FlyData Systems is not responsible for losses resulting from your failure to adequately protect your account credentials.
4. Acceptable Use
You agree to use the Services only for lawful purposes and in accordance with all applicable laws and regulations.
You must not use the Services to:
- Upload, transmit, or distribute malware, viruses, or other harmful software.
- Attempt to bypass, disable, or interfere with the security or operation of the Services.
- Violate the intellectual property, privacy, or other legal rights of any individual or organization.
- Publish or distribute unlawful, fraudulent, abusive, threatening, defamatory, hateful, obscene, or misleading material.
- Impersonate another individual or falsely represent your identity.
- Engage in activities that may expose FlyData Systems or its partners to legal or financial liability.
Any misuse of the Services may result in immediate suspension or permanent termination of your account.
5. Purchases and Payments
All purchases made through FlyData Systems are subject to successful payment authorization and product availability.
By placing an order, you agree that:
- Pricing will be displayed before payment is completed.
- Prices may vary depending on the destination, data allowance, promotional offers, or applicable taxes.
- Payments may be made using supported payment methods displayed during checkout.
- Payment card information is processed securely by authorized payment providers. FlyData Systems does not store your full payment card details.
Once payment has been successfully processed, your purchased eSIM or data plan will normally be made available immediately unless technical issues prevent activation.
6. Data Plans
Each eSIM and data plan is subject to its own validity period, coverage area, usage allowance, and any limitations specified at the time of purchase.
Customers are responsible for:
- Monitoring their remaining data balance.
- Renewing or purchasing additional plans when required.
- Ensuring that their selected plan meets their travel or connectivity needs.
Unused data generally expires at the end of the applicable validity period unless otherwise stated.
7. Device Compatibility
FlyData Systems provides services exclusively for devices that support eSIM technology.
Although we may offer compatibility tools or guidance before purchase, it remains your responsibility to verify that your device is unlocked, eSIM-compatible, and supported by your mobile carrier where applicable.
FlyData Systems cannot issue refunds solely because a customer’s device does not support eSIM functionality.
8. License to Use the Services
Subject to these Terms, FlyData Systems grants you a limited, revocable, non-exclusive, non-transferable license to access and use the Services solely for your personal or internal business purposes.
Unless expressly authorized by FlyData Systems, you may not:
- Sell, sublicense, lease, or commercially exploit the Services.
- Copy, reproduce, modify, or create derivative works from the application.
- Reverse engineer, decompile, or attempt to discover the source code of any part of the Services.
- Interfere with the operation, security, or availability of the platform.
- Use automated systems or software to access or extract data from the Services without our written permission.
All rights not expressly granted remain the exclusive property of FlyData Systems.
9. Chargebacks and Payment Disputes
All purchases made through FlyData Systems are considered final once an eSIM or data plan has been delivered or activated, except where refunds are required under applicable law or our Refund Policy.
If you request a chargeback or payment reversal through your bank or payment provider, you acknowledge and agree that:
- FlyData Systems may immediately suspend or terminate your account while the dispute is being investigated.
- We may submit evidence to the payment provider demonstrating that the purchase was completed, delivered, activated, or used.
- You remain responsible for any unpaid amounts, processing fees, or other costs arising from an invalid or unsuccessful chargeback.
Repeated, abusive, or fraudulent chargebacks may result in permanent account closure and may be reported to payment processors, financial institutions, or other appropriate authorities.
10. Fraud Prevention
To protect our customers, telecom partners, and payment providers, FlyData Systems actively monitors transactions for fraudulent or suspicious activity.
You agree not to:
- Use stolen, unauthorized, or fraudulently obtained payment methods.
- Create accounts using false or misleading identity information.
- Attempt to manipulate, duplicate, resell, or misuse eSIM products without authorization.
- Circumvent security controls, payment verification systems, or account restrictions.
- Engage in any activity intended to exploit, disrupt, or compromise our Services.
Where suspicious activity is detected, FlyData Systems may, without prior notice:
- Suspend or permanently close your account.
- Cancel pending orders or deactivate active services.
- Refuse future purchases.
- Share relevant information with payment processors, telecom providers, fraud prevention services, and law enforcement agencies where legally permitted.
- Take any additional action necessary to protect our business and customers.
11. Third-Party Services
Certain features of the Services depend on independent third-party providers, including mobile network operators, payment processors, cloud infrastructure providers, and other technology partners.
Although FlyData Systems carefully selects its service providers, we cannot guarantee uninterrupted availability where disruptions originate from third-party systems beyond our reasonable control.
We are not responsible for service interruptions, network outages, delays, or failures caused by external providers. However, we will make reasonable efforts to restore normal service as quickly as possible whenever practical.
12. Your Responsibilities
When using FlyData Systems, you agree to:
- Comply with all applicable laws and regulations.
- Provide accurate and current account information.
- Keep your account credentials secure.
- Use the Services responsibly and only for lawful purposes.
- Avoid any activity that may interfere with the operation or security of the platform.
- Cooperate with reasonable requests made during fraud or security investigations.
Failure to comply with these responsibilities may result in suspension or termination of your account.
13. Violations of These Terms
FlyData Systems reserves the right to investigate any suspected violation of these Terms.
Where appropriate, we may remove content, suspend accounts, terminate Services, restrict access, or take other actions considered necessary to protect our platform, customers, business partners, or legal interests.
We may also cooperate with regulatory authorities, payment providers, telecom operators, or law enforcement agencies where required by law or where necessary to investigate unlawful or fraudulent activities.
Nothing in these Terms obligates FlyData Systems to monitor all user activity, although we reserve the right to do so where appropriate.
14. Inactive Accounts
To maintain the security and efficiency of our platform, FlyData Systems may suspend or permanently remove accounts that remain inactive for an extended period.
Free accounts that have not been used for a prolonged period, or trial accounts that expire without conversion to a paid service, may be deleted after reasonable notice where applicable.
15. Changes to Services and Pricing
FlyData Systems continually improves its Services and therefore reserves the right to modify, replace, suspend, or discontinue any feature, product, pricing structure, or functionality at any time.
Where reasonably possible, we will provide advance notice of significant changes, scheduled maintenance, or service interruptions through email, the mobile application, or our website.
Prices for eSIMs, data plans, and related Services may change from time to time without affecting purchases already completed.
We may also revise these Terms whenever necessary to reflect legal requirements, business practices, or changes to our Services.
Any updated version will become effective once published unless otherwise stated. Your continued use of the Services after revised Terms become effective constitutes your acceptance of those changes.
16. Intellectual Property
Unless otherwise stated, all intellectual property rights relating to the FlyData Systems platform—including software, logos, trademarks, graphics, interfaces, text, design, databases, and other proprietary materials—remain the exclusive property of FlyData Systems or its licensors.
You retain ownership of any content or information that you submit through your account. However, by using the Services, you grant FlyData Systems the limited rights necessary to process, store, transmit, and display that information solely for the purpose of providing the Services.
FlyData Systems may use anonymous and aggregated usage information to improve products, generate statistical reports, enhance service performance, or produce industry benchmarking, provided that such information cannot reasonably identify any individual customer.
You may not reproduce, distribute, copy, modify, publish, reverse engineer, or otherwise use any part of the FlyData Systems platform without our prior written consent, except where expressly permitted by applicable law.
FlyData Systems will handle personal information in accordance with its Privacy Policy and applicable data protection legislation.
17. Access to Your Account
There may be occasions when authorized FlyData Systems personnel need to access your account to investigate technical issues, provide customer support, resolve billing concerns, or maintain the security and reliability of our Services.
By requesting technical assistance, you authorize our support team to access your account only to the extent reasonably necessary to assist you.
If you prefer that our staff not access certain information within your account, please let us know when contacting support. While we will respect such requests whenever reasonably possible, some issues may not be resolvable without limited account access.
18. Indemnification
You agree to defend, indemnify, and hold harmless FlyData Systems, its affiliates, directors, officers, employees, contractors, licensors, and business partners from any claims, losses, liabilities, damages, costs, or expenses (including reasonable legal fees) arising out of or relating to:
- Your use or misuse of the Services.
- Your breach of these Terms.
- Your violation of any applicable law or regulation.
- Any infringement of another person’s intellectual property, privacy, or other legal rights.
- Any activity carried out through your account by you or any person authorized by you.
This obligation survives the termination of your account or these Terms.
19. Disclaimer of Warranties
The Services provided by FlyData Systems are offered on an “as is” and “as available” basis.
To the maximum extent permitted by applicable law, FlyData Systems makes no express or implied warranties regarding the availability, reliability, accuracy, or suitability of the Services for any particular purpose.
We do not guarantee that:
- The Services will operate without interruption.
- Errors or defects will always be corrected immediately.
- Network coverage will be available in every location.
- Third-party mobile network providers will always provide uninterrupted connectivity.
- The Services will always be free from viruses, security threats, or technical issues.
Because mobile connectivity depends on independent telecom operators and internet infrastructure, occasional interruptions or service limitations may occur beyond our reasonable control.
Nothing in this section limits any rights that cannot legally be excluded under applicable law.
20. Limitation of Liability
To the fullest extent permitted by law, FlyData Systems shall not be liable for any indirect, incidental, consequential, punitive, or special damages arising from or relating to your use of, or inability to use, the Services.
This includes, without limitation:
- Loss of profits.
- Loss of business opportunities.
- Loss of data.
- Business interruption.
- Loss of goodwill.
- Any costs arising from service interruptions caused by third-party network providers.
Where liability cannot legally be excluded, FlyData Systems’ total liability for any claim relating to the Services shall not exceed the total amount paid by you for the affected Services during the 180 days immediately preceding the event giving rise to the claim.
These limitations apply regardless of the legal theory upon which a claim is based, including contract, negligence, tort, or statutory liability.
21. Governing Law and Dispute Resolution
These Terms shall be governed by and interpreted in accordance with the laws applicable to the jurisdiction in which FlyData Systems is incorporated, unless mandatory local consumer protection laws require otherwise.
Any dispute, claim, or legal proceeding arising from these Terms or your use of the Services shall be submitted to the courts having jurisdiction over FlyData Systems’ principal place of business, unless applicable law provides otherwise.
Before commencing formal legal proceedings, both parties agree to make reasonable efforts to resolve disputes through good-faith discussions.
22. General Provisions
If any provision of these Terms is found by a court or competent authority to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
Failure by FlyData Systems to enforce any provision of these Terms shall not constitute a waiver of that provision or any other rights available to us.
These Terms constitute the entire agreement between you and FlyData Systems regarding the Services and supersede any previous agreements or understandings relating to the same subject matter.
You are responsible for ensuring that your use of the Services complies with all laws and regulations applicable in your country or region.
